Predicate Logic, Inc. announced that their patent # 5,930,798, entitled “Universal Data Measurement and Analysis and Control System” has successfully emerged from an Ex Parte patent reexamination. The certificate was issued on 7 March 2006. Predicate Logic’s patented technology, also known commercially as Measurement Modeling Technology, has been implemented in its commercial software product called TychoMetrics. Measurement Modeling Technology is a fundamental technology at the core of an industry wide software metric data collection, analysis and reporting practices. CEO and inventor Jim Lawler said that “Our patent has emerged stronger than before, and revalidates our commitment to vigorously defend our intellectual property rights and seek licensing fees or infringement damages as appropriate.”

Predicate Logic has been involved in a patent infringement suit with a Virginia company named Distributive Software. Distributive, a Fredericksburg, VA firm sells metrics products that are the subject of the patent litigation. The case is now expected to resume in October with Markman hearings.

- Latest Patent News - The Patent & Trademark Office has indicated that they will re-issue Patent #5,930,798 for Universal Data Measurement, Analysis and Control System. This is the patent that was challenged by a competitor back in 1992. The re-issued patent will emerge from the PTO with all 20 claims and a technical narrowing of claim 15, but only to add the requirement that the method output a result (rather than just conducting a comparing). This narrowing of the claim does not result in any real loss in claim scope. Other changes actually serve to strengthen the claims by resolving claim drafting inconsistencies or clerical-type errors.
